I REFER to your report, “Derby-Lewis should not be freed — SACP” (July 4).

This comment has appeared with regularity for 20 years, gaining momentum after Clive Derby-Lewis’s truth commission hearing in 1997-98. Each time, our family has called on the South African Communist Party (SACP) to produce the evidence of the “wider conspiracy”, which lie they spread with impunity. Nothing is ever forthcoming. Despite calls by the Young Communist League to reopen the Chris Hani (pictured) case in 2006, the National Prosecuting Authority (NPA) declined, saying that even when the case was before the truth commission, “various (commission) organs could not establish new facts around Mr Hani’s murder”.

Derby-Lewis was recommended for parole by the Parole Board in 2007, for release in October 2008. The latter date came and went. We took the case to court and lost on spurious grounds. He was recommended twice more, and each time was refused by the minister at the time.

Early this year, I asked the police to reopen the case. I asked them to question Blade Nzimande, Jeremy Cronin and other SACP members who are still declaring there is a wider conspiracy. They did nothing — too scared, I believe, to question the untouchables. I’m now asking the NPA to take action. If these people continue to talk about a conspiracy when clearly there is none, they are guilty of obstruction of justice as it is this lie that has gone a long way to precluding Derby-Lewis from obtaining parole.

We will wait and see whether the NPA has the guts to confront these charlatans from the piggyback party.
